On May 4th, 2026, the U.S. Court of Appeals for the Sixth Circuit unanimously affirmed qualified immunity for two Akron police officers in the case of Kimberly Vaughn v. Matthew A. Akers and James Rea.

Case Background

The incident began when Mohammad J. Isaifan crashed his vehicle on a highway, left it blocking a lane, and was reported wearing a tactical vest. Officers Akers and Rea encountered him near his home. After a brief struggle in which Isaifan resisted commands and reached for a handgun, the officers fired in self-defense. Surveillance video was blocked by trees during the critical five seconds of the shooting, creating conflicting accounts.

The court specifically noted that “based on multiple CGI reconstructions, the government’s crime specialist likewise agreed that the evidence was consistent with the officers’ testimony” that the decedent was rotating toward them during the shooting. Our work, along with ballistic and autopsy analysis, helped fill in the obstructed moments and supported an objective understanding of the event.
